JUST CAR INSURANCE REEL DEAL COMPETITION TERMS AND CONDITIONS

PARTICIPATION

1. This competition ("Competition") is conducted by AAI Limited, ABN 48 005 297 807 trading as Just Car Insurance ("Promoter"). of Level 28 Brisbane Square, 266 George Street, Brisbane, Queensland 4000. Please direct any postal correspondence to “Just Car Marketing Team” at PO Box 14180, Melbourne City Mail Centre, Victoria 8001

2. All entry instructions and prize information published by the Promoter form part of these conditions. By entering, entrants accept these conditions.

3. The Competition is only open to individuals who: (i) are Australian residents aged 18 years or older at time of entry; and (ii) are not directors, management or employees, or their immediate family members, of the Promoter or its related companies or agencies associated with the Competition ("Eligible Entrant").

4. Competition entry commences at 9.00am on 5 November 2014 and closes at 5.00pm on 30 January 2015 ("Entry Period"). Except as otherwise stated, all times are Melbourne Australian Eastern Daylight time.

ENTRY

5. To enter the Competition, an Eligible Entrant must, during the Entry Period:

  1. Use a compatible browser to visit www.JustCarInsuranceReelDeal.com.au ("Competition Website").
  2. Click on the 'Enter' link and log onto their Facebook account.
  3. Click the Facebook 'Allow' button as prompted. This will permit the Promoter to access the Eligible Entrant's basic information (including name, profile picture, gender, user ID, locale, and any other Facebook information that is shared with everyone), to access and collect the Facebook ID of the Eligible Entrant.
  4. Complete the entry form with the required details including first name, last name, email, mobile, video title, video description and tick the box agreeing to the Competition's Terms and Conditions as well as to receive marketing communications including promos and news from the Promoter.
  5. Upload an original video of their own Just Car Insurance advertisement (maximum 60 seconds in length). The uploaded video must meet the requirements specified on the Competition Website, including the use of the specified end frame, messaging and sound track. An entry will be deemed ineligible if the uploaded video does not include the specified requirements.
  6. Have their uploaded video vetted and then featured on the Competition Website by the Promoter. Upon being featured on the Competition Website, the Eligible Entrant will receive one (1) entry into this Competition.

6. Eligible Entrants consent to the Promoter publishing their first name, initial along with their entry (or part thereof) on the Competition Website.

7. Only videos that are featured on the Competition Website by the Promoter, and made available for public viewing, will be considered eligible entries for the Prizes.

8. It is a condition of entry that Eligible Entrants consent to receive marketing communications from the Promoter and its related companies that use the Just Car Insurance brand, and do not opt out during the Entry Period.

9. An Eligible Entrant can submit multiple individual video entries. Each entry must comply with these Terms and Conditions. Each Eligible Entrant must create their own original entry and only submit an entry in their own name. Entries that are found to have been copied or derived in any way from any third party artistic work or works will be considered invalid and, if awarded a prize, the prize will be deemed void and withdrawn and/or recovered by the Promoter. An Eligible Entrant agrees to indemnify the Promoter and any agencies of the Promoter for any claims, costs, expenses, penalties or damages they incur from recording, featuring, publishing or advertising any works subsequently found to have been derived in any way from any third party artistic work or works. This indemnity extends to any legal costs incurred by the Promoter, or any other entity associated with this Competition, on a solicitor and client basis.

10. Entries must be received by the Promoter during the Entry Period. Entries will be deemed received at the time that the Promoter is satisfied that all necessary requirements under conditions, 3, 4 and 5 have been met and not at the time of submission by the Eligible Entrant. The Promoter takes no responsibility for late, lost, incomplete, incorrectly submitted, illegible or misdirected entries or delays or failures in any equipment or telecommunications service used to administer this Competition.

11. Cost of entry via the internet is free, but internet connection and usage rates may apply. Eligible Entrants should obtain details of such costs from their service providers.

12. Eligible Entrants must submit their internet entry manually. The Promoter may reject internet entries if it reasonably forms the opinion that they have been entered using automated entry means or by use of a competition entry service.

13. Entries that are found to have been derived from third party work will be considered invalid and, if awarded a prize, the prize must be returned to the Promoter. Each Eligible Entrant indemnifies the Promoter and its associated companies and agents for any claims, costs, expenses, penalties or damages they incur from reproducing, publishing or otherwise using any works subsequently found to have been derived in any way from any third party works.

14. Each Eligible Entrant warrants and agrees that:

  1. they have created their entry themselves;
  2. they are entitled to reproduce and exploit all underlying works in the entry;
  3. the entry does not, and use or exploitation of the entry by the Promoter (and each of its assignees and licensees) as contemplated by these conditions will not, violate the rights (including copyright and privacy) of any third person;
  4. the entry has not been previously published in any other medium or forum worldwide;
  5. they will not submit material that is unlawful, obscene, defamatory, derogatory, abusive, harmful to any person or entity, or otherwise inappropriate or offensive; and
  6. they have not granted rights to their entry to any other person which is inconsistent with the rights granted to the Promoter under these conditions.
  7. they will not submit material in their entry that is copyright protected in any way or otherwise subject to any third party proprietary rights, including privacy and publicity rights, unless the Eligible Entrant is the full owner of all such rights;
  8. they have obtained the consent of each friend/family member/third party featured in the video to enter the video in the Competition and for it to be used in accordance with these Terms and Conditions, and grant the same rights with respect to the use of the video as the Eligible Entrant does under these Terms and Conditions;
  9. they will upon request of the Promoter obtain a legal release and indemnity from the friends/family members/third parties who helped with or appeared in their video in a form determined by the Promoter
  10. they have not advertised or promoted any third parties' or the Eligible Entrant's own goods or services. Entries must not use third party artistic works, copyrights, trademarks, trade names, logos, similar brand identifying marks, trade secrets or other proprietary rights, other than the Promoter.

15. This important term explains the limitation of an Eligible Entrant's intellectual property rights with respect to the intellectual property associated with their entry. The Eligible Entrant freely agrees to this condition 15. Each Eligible Entrant acknowledges and freely agrees that the Promoter (and each of its assignees and licensees) has the exclusive right, in its absolute discretion, to edit, amend, copy, reproduce, re-record, use, publish, perform, broadcast and communicate to the public, the entry in any media including television and the internet (including production and release of the entry, whether in whole or in part or as part of a compilation work or sample), without any consultation (beyond the written agreement set out in these Terms and Conditions and any other related agreement entered into between the Promoter and the Eligible Entrant), any reference, or any payment or other compensation. The Entrant agrees that they will not make any claim against the Promoter, or any of their respective assignees and licensees, arising from the exercise of the above rights, including any claim in relation to any moral rights. For the avoidance of doubt, and to the fullest extent permitted by the law, the entry, becomes a work exclusively commissioned by the Promoter under these Terms and Conditions. All copyright with respect to the entry, as well as any moral rights with respect to that entry (including the right of attribution), transfers immediately. The Eligible Entrant agrees that they understand the limitations upon their intellectual property rights, as set out in these Terms and Conditions, and agrees that they have had the opportunity to seek independent advice about their decision to enter the Competition pursuant to these Terms and Conditions.

16. The Promoter may, in its absolute discretion, declare an entry invalid or disqualify any entrant that tampers with the entry process or benefits from such tampering, submits an entry that is incomplete or not in accordance with these conditions, or otherwise acts in a manner that is disruptive, dishonest or calculated to jeopardise the fair and proper conduct of this Competition.

17. The Promoter reserves the right to require an entrant to verify the validity of their entry within the requested time, including but not limited to an entrant’s identity, eligibility, age and address and to disqualify any entrant who does not satisfy any entry criteria in these conditions. Errors and omissions may be accepted at the Promoter’s discretion. Proof considered suitable for verification is at the Promoter’s discretion.

JUDGING AND PRIZE(S)

18. This Competition is a game of skill and chance plays no part in determining the winner(s).

19. There are 2 Prizes, the Major Prize, and the People's Choice Award (each, a "Prize").

20. Only one winning entry will be chosen to win the Major Prize. The properly submitted entries of all Eligible Entrants will be judged by representatives of the Promoter at 11:00am on 3 February 2015 at the Promoter’s offices at 530 Collins St, Melbourne, VIC. Valid entries will be judged based on creativity, effort, execution, and alignment with the spirit of the Competition (“Criteria”), and one (1) winner (“Prize Winner”) will be selected to win the Major Prize. A further two (2) entries will be selected in reserve under the same judging criteria (and ranked second and third respectively) only in case the first selected Prize Winner cannot be successfully contacted or their eligibility confirmed.

The Major Prize is $10,000 cash, which will be transferred to the Major Prize Winner by Electronic Funds Transfer (EFT) upon notification of account details and confirmation of identity and eligibility.

21. During the Entry Period eligible visitors to the Competition Website will be able to vote for the video entries they like best, using the Promoter's own voting mechanism by following the instructions set out on the Competition Website. Visitors who register will be able to vote on multiple video entries, however they will only be able to vote once for any single video entry. The video entry with the most votes as at 5:00pm on 30 January 2015 will win the People's Choice Award ("Prize Winner"). In the event that there is a tie in votes, the Promoter will judge the tied video entries and select a Prize Winner based on creativity, effort, execution, and alignment with the spirit of the Competition. The Promoter's decision will be final and no correspondence will be entered into.

The People's Choice Award Prize is $2,000 AUD cash, transferred to the People's Choice Award Prize Winner by Electronic Funds Transfer upon notification of account details and confirmation of identity and eligibility.

22. The total prize pool is valued at $12,000 AUD including GST as at 1/10/14. The Promoter takes no responsibility for any variation in a prize's value due to exchange rate changes or otherwise.

23. Any additional costs not expressly stated, but which may be incurred in acceptance and use of a prize, are the responsibility of the winner.

24. No compensation will be payable if a winner is unable to take any element of a prize as stated, or does not satisfy any conditions of use for any element of the prize (including conditions imposed by event organisers or staff, or other prize providers, such as health, behaviour, age and safety requirements), for whatever reason. Any part of a prize that is not taken for any reason is forfeited and no compensation will be provided.

25. If a prize (or part of a prize) is unavailable for any reason, the Promoter may, in its absolute discretion, substitute alternative goods or services of equal or higher value. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if a prize (or part of prize) is unavailable for any reason.

26. Other than as expressly stated in these conditions, a prize is non-transferable, non-refundable, non-exchangeable, non-replaceable, and non-redeemable for another prize, except at the Promoter's discretion.

27. It is a further condition of accepting any Prize that the Prize Winner may each be required to sign a legal release in the form determined by the Promoter.

28. Each Prize Winner accepts the Prize at his or her own risk. The Promoter, its associated entities and agencies and their personnel shall not be liable for any death, injury, loss or damage (including any claim, costs or expenses) whatsoever that is suffered by any Eligible Entrant, Prize Winner or assignee of the Prize (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of taking and/or using any Prize, except for any liability that cannot be excluded by law. The Promoter shall not be responsible for any entries that are not received or are otherwise interfered with due to problems with the internet or telecommunications services. No responsibility will be taken by the Promoter for any incomplete, late, lost or misdirected entries. The Promoter recommends that tax and/or financial advice is sought by any Prize Winner at the time of accepting any Prize.

PRIZE WINNER(S)

29. The winner(s) will be notified by a phone call and written message that will be sent by email to the email address provided by them in the entry within two working days of them being selected as a Prize Winner. The name of the winner(s) will also be published at the Competition Website.

30. The prize notification will include instructions as to how the winner is to claim their prize.

31. The prize(s) will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.

32. If: (i) a prize is not claimed by a winner or the Promoter has been unable (despite reasonable efforts) to successfully contact the winner over a period of 30 days from the time they are selected by the Promoter; or (ii) a winner is determined by the Promoter to be ineligible to win a prize in accordance with these conditions, then the People's Choice Award will be awarded to the Eligible Entrant with the second highest number of public votes (as at the end of the Entry Period) and/or the Major Prize will be awarded to the Eligible Entrant whose video is judged to be second best by the judging panel. The resulting Prize Winner will be notified by a phone call and written message that will be sent to the e-mail address provided by them in their entry.That process will be repeated if required.

GENERAL

33. If for any reason this Competition is not capable of running as planned, or is interfered with or disrupted in any way (including by vandalism, power failures, natural disasters, acts of God, weather event, civil unrest, strikes, computer bugs or viruses, tampering or technical failures), the Promoter reserves the right to cancel, terminate, modify or suspend the Competition, or invalidate any affected entries.

34. The Promoter assumes no responsibility for: (i) any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise; (ii) any theft, destruction or unauthorised access to, or alteration of such communications; (iii) any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Competition; (iv) any incorrect or incomplete information which may be communicated in the course of the administering this Competition (whether as a result of one of the foregoing causes or otherwise); or (v) any delay in delivery (when not directly caused by the Promoter or its supplier), or failure of safe delivery of a prize.

35. All of the Promoter's decisions in relation to all aspects of this Competition are final and no correspondence will be entered into. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

36. A winner accepts a prize at their own risk. Any tax liability arising as a result of accepting a prize is the responsibility of the winner. Independent financial advice should be sought.

37. To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competition or a prize, including without limitation: (i) any indirect, special, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; and (iii) any liability for personal injury or death. To the extent that such liability cannot be excluded by law, it is limited to the minimum allowable by law.

38. The winner(s) must, at the Promoter's request, participate in all promotional activity (such as publicity and photography) surrounding winning a prize, free of charge, and consent to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in promotional material in any media at any time without notification or compensation, financial or otherwise.

39. Each entrant completely releases Facebook from any and all liability in relation to this Competition, and acknowledges that this Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Eligible Entrants understand that they are providing their information to the Promoter and not to Facebook. The Promoter reserves the right to modify any of the Terms and Conditions outlined in order to comply with changes to the Facebook promotion guidelines, but always subject to the prior approval of all relevant State and Territory gaming authorities.

PRIVACY AND MARKETING CONSENT AND DISCLOSURE

40. Entrants' personal information is collected from entrants by or on behalf of the Promoter to enable the Promoter and its agents to manage, administer and promote the Competition and, where applicable, publicise the winner(s). The personal information may also be provided to persons assisting the Promoter, including prize suppliers and deliverers, marketing agencies and IT providers, media outlets and related companies. The winner's name will also be published at the Competition Website. By participating in the Competition, Eligible Entrants consent to these uses and disclosures of their personal information.

41. If an Eligible Entrant does not provide the personal information the Promoter requests, the Promoter may not be able to enter them into the Competition. All personal information is handled in accordance with these conditions and the Promoter's Privacy Policy. Information about how to access or correct the personal information that the Promoter holds about you, or complain, can be found in the Promoter's Privacy Policy available online at http://www.justcarinsurance.com.au/privacy.

42. Entry into the Competition also entitles the Promoter and any related companies that use the Just Car Insurance brand ("we"/"us") to let the Eligible Entrant know from time to time about news, offers, products and services they might be interested in (by any means, including telephone, email, mail, SMS or online marketing). In order to carry out direct marketing, entrants' personal information will be collected from and disclosed to others that provide us with specialised data matching, trending or analytical services, as well as general marketing services. We, and other people who provide us with services, may combine the personal information collected from entrants or others, with the information we, or other companies in the Suncorp Group, or our service providers already hold about entrants. We may also use online targeted marketing, data and audience matching and market segmentation to improve advertising relevance. Each Eligible Entrant agrees that they must provide and/or maintain their consent to receive such marketing communications and not opt out of receiving such communications during the Entry Period.

PARTICIPATION

  3. Select a video they like best, select the Vote button and log onto their Facebook account.

This will permit the Promoter to access the Eligible Entrant's basic information (including name, profile picture, gender, user ID, locale, and any other Facebook information that is shared with everyone), to access and collect the Facebook ID of the Eligible Entrant.
  5. Complete the vote form with the required details including first name, last name, email, mobile phone and tick the box agreeing to the Competition's Terms and Conditions as well as to receive marketing communications including promos and news from the Promoter.
  6. Vote for one or more videos submitted to the Competition Website, as part of the entry process set out in this Condition 5. An Eligible Entrant can only vote once for any single video entry, and the sum of their votes only provides one (1) single entry into the Competition.

6. Once an Eligible Entrant has voted in accordance with Condition 5, they are still free to visit the Competition Website and vote for new or other videos which they have not previously voted for, however each of those subsequent votes will not result in an additional entry into the Competition or otherwise increase their chance of winning.

7. Entrants may only enter the Competition in their own name.

8. Entries must be received by the Promoter during the Entry Period. DRAW AND PRIZE(S)

13. All valid entries received during the Entry Period will be entered into the prize draw. The random prize draw will be held at 2.00pm on 4 February at Salmat Digital Pty Ltd, Level 2, 116 Miller Street, North Sydney.

14. There is one prize to be won. The first valid entry randomly drawn will win the prize. The prize consists of these three components (the Prize is also known as the "Entertainment pack"):

- 1 Samsung 60 inch Full HD LED LCD Smart TV valued at $1,498;

- 1 PlayStation 4 Console valued at $548; and

- 1 ‘Driveclub' Playstation 4 Game valued at $98.

PROVISIONS APPLICABLE TO PRIZE(S) GENERALLY

15. The total prize pool is valued at $2,144 AUD including GST as at 1 October 2014. A prize value is the recommended retail value as provided by the relevant supplier(s). The Promoter takes no responsibility for any variation in a prize's value due to exchange rate changes or otherwise.

16. Any additional costs not expressly stated, but which may be incurred in acceptance and use of a prize, are the responsibility of the winner.

17. No compensation will be payable if a winner is unable to take any element of a prize as stated, or does not satisfy any conditions of use for any element of the prize (including conditions imposed by event organisers or staff, or other prize providers, such as health, behaviour, age and safety requirements), for whatever reason. Any part of a prize that is not taken for any reason is forfeited and no compensation will be provided.

18. If a prize (or part of a prize) is unavailable for any reason, the Promoter may, in its absolute discretion, substitute alternative goods or services of equal or higher value, subject to the approval of any relevant gaming authority, where required. The Promoter accepts no other liability or responsibility for any loss incurred by a winner or any other party if a prize (or part of prize) is unavailable for any reason.

19. Other than as expressly stated in these conditions, a prize is non-transferable, non-refundable, non-exchangeable, non-replaceable, and non-redeemable for another prize including cash, except at the Promoter's discretion and subject to relevant State and Territory legislation.

PRIZE WINNER(S)

20. The winner(s) will be notified within 2 days of the draw by mobile phone or by the email address they provided at entry, by no later than 6 February 2015.

21. The name of the Prize Winner will be published in The Australian newspaper on 9 February 2015.

22. The prize will be sent by registered post to the winner(s) at their nominated Australian address within 28 days of the draw.

23. The prize(s) will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.

24. The name of the winner(s) and their State or Territory of residence will be published at the Competition Website on 6 February 2014 for a minimum period of 28 days.

25. Subject, where relevant, to any directions given by a relevant gaming authority, if: (i) a prize is not claimed by a winner or the Promoter has been unable (despite reasonable efforts) to successfully contact the winner on or before 4 May 2015; or (ii) a winner is determined by the Promoter to be ineligible to win a prize in accordance with these conditions, the relevant prize will be forfeited and instead awarded to another Eligible Entrant in a redraw. Any such redraw will be made from a pool of the remaining Eligible Entrants and will take place at 2.00pm on 5 May 2015 at the same location as the original draw, with any unclaimed prizes awarded to the next valid entry randomly drawn in descending order of value (if applicable). The name of any resulting winner(s) and their State or Territory of residence will be published on the Competition Website within 2 weeks of the draw. Any redraw prize winner(s) will be notified within 2 days of the redraw by an email using the details provided in their entry. The name of the redraw Prize Winner will be published in The Australian newspaper on 8 May 2015.

26. To the full extent permitted by law, the Promoter, its associated companies and agencies and any of their personnel (the "Relevant Parties") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant in connection with the Competition or a prize, including without limitation: (i) any indirect, special, economic or consequential loss; (ii) any loss arising from the negligence of a Relevant Party; and (iii) any liability for personal injury or death. To the extent that such liability cannot be excluded by law, it is limited to the minimum allowable by law.

31. The winner(s) must, at the Promoter's request, participate in all promotional activity (such as publicity and photography) surrounding winning a prize, free of charge, and consent to the Promoter using their name, likeness, image and/or voice (including any photograph, film and/or recording of them) in promotional material in any media at any time without notification or compensation, financial or otherwise.

32. Each entrant completely releases Facebook from any and all liability in relation to this Competition, and acknowledges that this Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Eligible Entrants understand that they are providing their information to the Promoter and not to Facebook. The Promoter reserves the right to modify any of the Terms and Conditions outlined in order to comply with changes to the Facebook promotion guidelines, but always subject to the prior approval of all relevant State and Territory gaming authorities.

PRIVACY STATEMENT AND MARKETING CONSENT

33. Entrants' personal information is collected from entrants by or on behalf of the Promoter to enable the Promoter and its agents to manage, administer and promote the Competition and, where applicable, publicise the winner(s). The personal information may also be provided to persons assisting the Promoter, including prize suppliers and deliverers, marketing agencies and IT providers, and to gaming authorities, media outlets and related companies. The Promoter will disclose a winner's first initial, surname and State/Territory of residence to The Australian newspaper for publication. The winner's name will also be published on the Competition Website. By participating in the Competition, Eligible Entrants consent to these uses and disclosures of their personal information.

34. If an Eligible Entrant does not provide the personal information the Promoter requests, the Promoter may not be able to enter them into the Competition. All personal information is handled in accordance with these conditions and the Promoter's Privacy Policy. Information about how to access or correct the personal information that the Promoter holds about you, or complain, can be found in the Promoter's Privacy Policy available online at http://www.justcarinsurance.com.au/privacy.

35. Entry into the Competition also entitles the Promoter and any related companies that use the Just Car Insurance brand ("we"/"us") to let the Eligible Entrant know from time to time about news, offers, products and services they might be interested in (by any medium, including telephone, email, mail, SMS or online marketing). In order to carry out direct marketing, entrants' personal information will be collected from and disclosed to others that provide us with specialised data matching, trending or analytical services, as well as general marketing services. We, and other people who provide us with services, may combine the personal information collected from entrants or others, with the information we, or other companies in the Suncorp Group, or our service providers already hold about entrants. We may also use online targeted marketing, data and audience matching and market segmentation to improve advertising relevance. Each Eligible Entrant agrees that they must provide and/or maintain their consent to receive such marketing communications and not opt out of receiving such communications during the Entry Period.
